Present Court Case Position Of OA-655-2010

Hearing of contempt Petition reg. OA 655 - 2010 reg Modified Parity of Pension was held on 28-3-2012. Govt advocate tried to persuade the Petitioners counsel to agree for discharge of contempt as matter was in HC. He was told that as per HC orders of 19th, Petitioners had only agreed not to press the matter till 4th May. Early date soon after 4th May was requested and next date is 9th May for contempt petition.

Sub:- Grant of Fixed Medical Allowance to Widowed/Divorced/Unmarried daughter in receipt of family pension- clarification reg.

Some references pointing out doubts regarding admissibility of Fixed Medical Allowance (FMA) to Widowed/Divorced/Unmarried daughter in receipt of family pension has been received in Board’s office. In this context, attention is invited to Board’s letter No. PC-V/98/I/7/1/1 dt. 21-4-1999 and 01-03-2004 whereby sanction of the President has been accorded to grant of Fixed Medical Allowance to Railway pensioners/ family pensioners residing beyond 2.5 Kms from a Railway hospital/Health Units subject to fulfillment of conditions laid down therein.

From the above, it is evident that Widowed/divorced/unmarried daughters in receipt of family pension being family pensioner are already covered by relevant instructions and may be extended benefit of grant of FMA provided they fulfill all other terms and conditions in this regard.

As regard the date of eligibility for grant of Fixed Medical Allowance to Family Pensioners, it is clarified that in cases where the existing pensioner/family pensioner was in receipt of Fixed Medical Allowance, the family pensioner next-in-line may be allowed Fixed Medical Allowance from the same date from which he/she becomes eligible for family pension, if he/she otherwise fulfills the conditions for grant of Fixed Medical Allowance.

This issues with the concurrence of Finance Directorate of the Ministry of Railways.

PENSIONERS’ DAY OBSERVED AT STATE BANK OF INDIA,MADHUPUR MAIN BRANCH ON 18-12-2014

This gathering was organized by the Bharat Pensioner Sanaj,Madhupur and sponsored by the State Bank Of India,Madhupur

Meeting was organized remembering the historic supreme court of india judgement –writ petition Nos.5939-41- of 1980 & judgement dated 17-12-1982-THE CASE OF D.S.NAKARA specified now a days as INTERNATIONAL PENSION DAY.

Just at the beginning,,Sri K.P.Ghosh,was requested by Sri Madhukar Sah,Chief Manager,State Bank Of India,Madhupur Branch for conducting the meeting.

Sri K.P.Ghosh requested all pensioners to observe 2”Silence,rembering the unwanted happening at Peshwar-Pakisthan on 16-12-2014 and the entire segment were present, tributed for the departed soul.

Agenda-(a)-1.Sri Narayan Mahato,President Rly Pensioner Association,Madhupur was requested to clarify .Sri Mahato expressed a few pension payment problems, as he observed at this branch,but could not clarify the actual reason of the agenda (a).-2.Janab Altaf Hussain,Secretary Rly Pensioner Association,Madhupur was called to speak about the above question and about any other pension related sughgestions,but, Janab Altaf Hussain also failed to justify the question in agenda(a)-(3).Sri M.P.Sharma-Office Bearar,ofRlyPensionerAssociation,Madhupur, demanded issue of Pension Slip each month to the pensioners but,Shri Sharma also fail to express his openion as asked in agenda (a).

Agenda (b,c&d).No specific complaints found unattended,as raised by the pensioners,However,.

NAKARA-CASE

It was on the 17^th December 1982, that the Supreme Court of India in a landmark judgment in the case of D.S. Nakara and others vs. Union of India, held that : Pension is neither a bounty nor a matter of grace depending upon the sweet will of the employer. It is not an ex gratia payment, but a payment for past services rendered.

In reply to the proposal as raised by Sri M.P.Sharma,an Office bearer of the Rly Pensioner Association,Madhupur,Sri K.P.Ghosh,expressed his openion that, Pension slip may be issued when the amount of the Basic Pension raised by revision of pension or the DA/DR raised.

The luncheon was presided by Sr R.N.DFutta,Ex.Vice President,Bharat Pensioner Samaj,New Delhi,He added during closing of the function,that,”Though,at present,I am not holding any post of Bharat Pensioner Samaj-New Delhi,but still I promise to look after the problems of the Railway Pensioners of the Eastern Zone”.

1.380 delegates from all over the country participated in 57^th AGM of Bharat Pensioners Samaj the largest & oldest Federation of Indian Pensioners (with international positive track record) at 12,Chemsford Road N.Delhi. Proceedings which started with the singing of National anthem paying homage to departed souls was presided over by its President K.C.Pipal

Dr Mala Kapur Shankardass, Socialogist, Health scientist &Gerontologist of international fame, graced the morning Session as chief Guest. AICCPA President SS Ramachandran. AIFPA Chennai, Joint General Secretary MRV Nath, V. Krishnamurti Secy. (Railway) of Chennai were the distinguished guests.

2. 9 Associations & 3 individuals were awarded for their outstanding services to Pensioners & Family Pensioners .This years’ Daya Maheshwari memorial Trophy went to NFRPA New Jalpaiguri & S.P.Vatta memorial Trophy was awarded to Postal officers Pensioners Association(POPA) Secunderabad (A.P.).

31 Sr members on their having attained the age of 80 years were admitted to Platinum Age brother hood & were honored with a shawl & Citation Certificate.

The rate of dearness allowance payable to central government employees might be enhanced from 72% to 80% with effect from January 2013

All India Consumer Price Index Number for Industrial Workers is the only Index watched keenly by each and every Central Government Employees now. Because the rate of Dearness allowance granted twice in a year for cg employees is determined by this Index only. It is irony that no one is happy to see the hike in prices of essential commodity, but all the government servants are eagerly awaiting to know how much the rate of Dearness allowance will be increased at the end of every 12 months from the month of January and July. The interesting thing to be noted in dearness allowance vs AICPIN_IW is that the AICPIN-IW reflects the increase in the prices of basket of essential commodities, whereas, the rate of dearness allowance reflects the increase or decrease in AICPIN-IW. It is quite obvious that the AICPIN – IW is always in the trend of increasing mode due to the price rise, so as the rate of dearness allowance is also increasing twice in a year.

Whatever the impact on the exchequer of the government on account of releasing additional installment of dearness allowance and dearness relief is inevitable. The additional installment of dearness allowance and dearness relief to central government employees and pensioners is released particularly to compensate for price rise. The increase is determined in accordance with the accepted formula, which is based on the recommendations of the 6th Central Pay Commission.

To determine the exact rate of dearness allowance to be increased, we need the AICPIN – IW for the month of December 2012. Although, as per the past eleven month’s Consumer price Index number for Industrial workers, it is expected that the rate of dearness allowance payable to central government employees might be enhanced from 72% to 80% with effect from January 2013

May I wish you all a very happy and prosperous new year 2013. In the year 2012,there was excellent performance by Bharat Pensioners’.Its continuous endeavors for a better dispensation for C.G. Pensioners as well as Senior Citizens have won the appreciation of one and all. The BPS has been able to mobilize a large number of pensioners and family pensioners in all its programmes. It created a new enthusiasm among its rank and file. Its 3^rd National Convention of Railway Pensioners at New Jalpaiguri on 31^st March, 2012 had surpassed all expectations and gave a big fillip to our movement. Participation of more than 300 family pensioners in the procession taken out there in the above connection was a unique feature unheard of in the annals of pensioners’ movement in our country. Our Mass Dharna at JantarMantar, New Delhi on October 11, 2012 was a grand success. It demonstrated beyond doubt the capacity of BPS to rise to new heights in championing the cause of pensioners. In collaboration with AISCCON, BPS has taken the first steps to awaken pensioners and retirees in various sectors about the imperative need to come together to secure justice at the hands of powers that be. Their combined efforts will take a long awaited concrete shape at a National Convention of these sections proposed to be held at Hyderabad in October/November 2013, coinciding with the 58^th annual meeting of BPS.

The BPS is holding the 4^th National Convention of Railway Pensioners on 9.2.2013 at Nagpur. The Nagpur convention has not only to give a new impetus but also a new direction to the Central Government Pensioners’ Movement in general and Railway Pensioners Movement in particular. It is no exaggeration that central government and railway pensioners throughout the country are eagerly looking forward to this convention to give the necessary lead..

Our experience has shown that we cannot set much store on SCOVA to find satisfactory and long lasting solutions to our problems and demands. The VI CPC had singularly failed to meet the just and legitimate aspirations of central government pensioners. It gave a raw deal to the past pensioners with the result they are so much frustrated today. Even those retiring after 1.1.2006 are not sanguine about a better future. By failing to invite the Pensioners’ Organizations for tendering oral evidence before them, the VI CPC had shown utter contempt to the past pensioners who were at the fag end of their lives. They abandoned parity principle enunciated by the V CPC. They did not recommend to them the same fitment benefit as given to serving employees. They also failed to recommend extension of new benefits to past retirees.

There are no satisfactory solutions to the issues raised in the National Anomaly Committee as well as in the SCOVA. Issues are being dragged on indefinitely to the serious discontent and frustration of large number of pensioners and family pensioners. Even where Court Judgmentsare in our favour, the authorities do all in their power to prolong the litigation to tire out the pensioners. Important benefits such as restoration of commuted pension after 12 years, 50% DR merger, appointment of VII CPC, enhancement of FMA etc., are being pushed under the carpet on one pretext or another.

In the above circumstances, how to overcome the hurdles and make progress? The Nagpur convention should find the answers. It should give a new impetus and direction to our movement to take it forward to newer heights to meet the just aspirations of central government pensioners and to fill them with a new hope and confidence about their future. Only a strong movement will deliver the goods. Let us do all in our power to make the Nagpur convention a great success.

PRESS INFORMATION BUREAU GOVERNMENT OF INDIA ***** MEETING OF THE CONSULTATIVE COMMITTEE ATTACHED TO THE MINISTRY OF FINANCE HELD; VARIOUS SUGGESTIONS MADE FOR CONSIDERATION FOR INCLUSION IN THE FORTH COMING UNION BUDGET New Delhi: Magha 15, 1934 February 4, 2013 The first meeting of this year of the Consultative Committee attached to the Ministry of Finance was held here today under the Chairmanship of the Union Finance Minister, Shri P. Chidambaram. Making his opening remarks, the Finance Minister said that subject matter of the today’s meeting was Pre Budget Consultations and therefore, he invited the members to give their valuable suggestions in this regard. Participating in the discussion, members present gave various suggestions. Some of the members suggested that the budget should be practical, reasonable and visionary. They said that budget should give incentive for job creation, growth oriented and give recognition to young entrepreneurs and innovators. It should focus on water conservation and urban renewable by tackling both environmental and physical degradation in this area. Some members focused on the incentives for the youth stating that home loans may be provided at cheaper rate of interest for the youth up to the age of 35 years and scope of MGNREGA be expanded to include creation of human assets along with physical assets in the rural areas. Some members suggested to give incentives to small agro based and food processing industries in rural areas to create more employment opportunities for rural people which would help in tackling the problem of migration from rural to urban areas. Rural based infrastructure should also be given priority to achieve the same objective. Certain members suggested for focusing on providing of drinking water facilities, tackling of garbage problem & sewerage related issues and providing basic facilities of health and education in rural areas. For that they suggested that the budget of the Ministries of Rural Development and Human Resource Development may not be reduced. Suggestions were made to enlarge the scope of Pradhan Mantri Gram Sadak Yojana and Rajiv Gandhi Grameen Vidyutikaran Yojana to include small village hamlets rather than covering only revenue villages. Some suggestions were made regarding setting-up of Skill Development Centres at district level to make them easily accessible to the youth. It was also suggested to include fertilizer and seed subsidy under direct benefit transfer scheme at the earliest. Suggestion was made to focus on middle class in this year budget. Suggestion was also made to broad base the tax network. Suggestion was made to minimize centrally sponsored schemes and focus on quality control and enforcement of those central schemes which are 100% funded by the Central Government. Hijacking of centrally sponsored schemes by the State Governments shall be seriously dealt with. Suggestions for relief from dividend distribution tax to the Indian companies having set-up subsidiary companies outside in foreign countries and want to bring the dividend back to the country. Relief from excise duty on 14 inch color TV sets below the cost of Rs. 2000/- was also sought. It was suggested to include multi-level car parking projects back in the infrastructure sector. Suggestions to reduce service tax on food items, clarification regarding service tax on storage of food grains and customs duty relief on sports equipments etc. were also made. Along with the Union Finance Minister, both the Minister of State for Finance Shri S.S. Palanimanickam and Shri Namo Narain Meena, Adviser to the Finance Minister, Shri Parthasarthy Shome, Finance Secretary, Shri R.S. Gujral, Revenue Secretary, Shri Sumit Bose, Secretary, Department of Economic Affairs, Shri Arvind Mayaram, Secretary, Disinvestment, Shri Ravi Mathur, Secretary, Financial Services, Shri Rajiv Trakru, Chairperson CBDT,Dr. Poonam Kishore Saxena and Chairman CBEC, Ms. Parveen Mahajan alongwith other senior officers of Ministry of Finance also attended the said meeting. Arjun Munda Govt.Jharkhand!

hi, Jan 8 (IANS) Jharkhand Chief Minister Arjun Munda resigned Tuesday after the Jharkhand Mukti Morcha (JMM) formally withdrew support to his government.

The Bharatiya Janata Party (BJP) leader met Governor Syed Ahmd just before noon and handed over his resignation.

The Munda government was Monday reduced to a minority after the JMM announced that it was pulling out of the coalition ministry.

The crisis was triggered by Munda's letter of Jan 3 stating that the chief minister's post would not be given to the JMM when the government completes 28 months in office.

The Jharkhand cabinet Tuesday recommended the dissolution of the assembly.

The BJP-led government was formed in September 2010 with the support of 18 JMM, six All Jharkhand Students Union (AJSU) and two JD-U legislators. The BJP also has 18 legislators.

Mr. Nidhesh Gupta, Senior Advocate for the Respondents (Pensioners) started his arguments in the High Court on 7-5-2012 in WP 1535-2012 - on the issue of Modified Parity of Pension to the Pre-2006 Pension - as per accepted recommendations of Sixth CPC - with the Minimum Revised Pension being not less than 50% of the Pay in the Pay Band plus Grade Pay of the scale from which one retired - as up-held by PB CAT New Delhi Judgment in OA 655 / 2010. Further hearing will continue on Monday 21st May, 2012

Medical facilities to Rly Employees and Pensioners!

Reg: Medical Facilities & RELHS: Henceforth all the Railway employees will be covered under RELHS (Railway Employees Liberalised Health Scheme) and Retired employees will also be a part of this scheme (as hitherto fore) with a “lock-in period” of six months. But within six months if there is any emergency, they will be treated at par with RELHS covered employees. For & up to F.Y.2004-2005 Sr. Citizens were getting, concession in income tax payable (under section 80CC) to the tune of Rs 20000/-as compared to other citizens with similar taxable income. In 2005-2006 this was changed, basic exception for other citizens was raised to Rs 100000/- & that for Sr Citizens it was made 185000/- This resulted in actual Tax relief of Rs12000/- instead of Rs 20000/-.Thereafter it has been progressively reduced & today it stands at just Rs5000/-

Brief Information on Association. All India Central Government Pensioners' Association had been established during 1947. Thi association is the first and oldest association of pensioners from central government department This was originally formed by pensioners from P& T Department and initially membershi During general body meeting in 197 was limited to pensioners from P&T Department only. a resolution was passed to welcome pensioners from all other central Governmen services/departments/offices and central Government Public sector undertakings to join thi association. Association received enthusiastic response. Now it represents most of the centra government services/departments/offices and public sector undertakings. Some departments lik Indian Railways have their independent association. However, we have meaningful dialogu with other associations. Association had been registered under society act and registration No. is MAH 0938 (Publi Trust Certificate No. F 753 Pune) Head Quarter of this association is located in Pune in its ow building. Heard learned counsel for the petitioner.
Learned counsel for the petitioner submits that in the third and fourth
line of para 14 of order dated 07.12.2011, it is mentioned that “fixation should
be done from the date of issuance of the notification”, however it should be
“fixation should be done from the date of implementation of the notification” as
the notification dated 11.11.2008 has been made into effect from 01.01.2006.
Therefore, learned counsel submits that this is a bonafide error and it should
be corrected accordingly.
We have gone through the order in question and the applications. We
are of the opinion that the expression “fixation should be done from the date
of issuance of the notification” in third and fourth line of order dated
07.12.2011 shall be read as “fixation should be done from the date of
implementation of the notification i.e. from 01.01.2006”. Hence, this corrected
expression should be substituted in order dated 07.12.2011. Both applications
stand disposed of accordingly.

OFFICE MEMORANDUM

Subject: Central Civil Services (Revised Pay) Rules, 2008 - the re-exercise of option under Rule 6 of the Central Services (Revised Pay) Rules, 2008 in case of employees covered under the OM dated 19.3.2012.

The undersigned is directed to invite a reference to Rules 5 & 6 of the CCS(RP) Rules, 2008, as per which a Central Government employee had an option to elect to come over to the revised pay structure either from 1.1.2006 or from the date of his next increment or from the date of promotion, upgradation of pay scales. Such an option was to be exercised within 3 months from the date of publication of CCS (RP) Rules, 2008. The rule also provides that the option once exercised shall be final.

2. This Ministry issued instructions vide this Departments OM No.10/2/2011-E-IIIA dated 19.3.2012, providing that those Central Government employees who were due to get their annual increment between February, 2006 to June, 2006 may be granted one increment on 1.1.2006 in the pie-revised pay scale as a one time measure and, thereafter, they will get the next increment in the Revised Pay structure on 1.7.2006 as per Rule 10 of the CCS (RP) Rules 2008.

In view of the benefit extended to Central Government employees as per the aforesaid OM dated 19.3.2012, the issue relating to according of a fresh opportunity to Central Government employees to re-exercise their option to come over to the revised pay scale as per CCS(RP) Rules, 2008 was raised by the Staff side of the Joint Consultative Machinery in the meeting of the National Anomaly Committee held on 17.7.2012.

4 The matter has been considered by the Government and having regard to the fact that the provisions of the aforesaid OM dated 19.3.2012 bring about a material change in the basis for exercise of option to come over to the revised pay structure in terms of the CCS(RP) Rules, 2008 in respect of employees who are covered under the said OM dated 19.3.2012, the President is pleased to decide that all those employees who are covered under the provisions of the aforesaid OM dated 19.3.2012 may once again be permitted to re-exercise their option to come over to the Revised pay structure.

5. The benefit under these orders for re-exercise of option shall be available for a period up to 31.3.2013. The revised option shall be intimated to the head of the office by the concerned Government employees in accordance with the provision of Rule 6 (2) of the CCS (RP) rules, 2008.

6. All the Ministries and Departments are requested to bring the content of this OM to the notice of their employees so that such employees can avail themselves of the same within the stipulated time period.

7. In so far as persons serving in the Indian Audit and Accounts Department are concerned, these orders issue after consultation with the Comptroller and Auditor General of India.
